Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Beauty & Tattoo Creator OS (“we,” “us,” or “the App”). By creating an account or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Who can use the App
The App is intended for independent beauty and tattoo professionals and studios acting in a professional capacity. You must be at least 18 years old and able to form a binding contract to create an account. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
2. The service
The App helps you turn before/after photos into ready-to-publish social content, manage client conversations and records, work out when you are free so you can offer appointment times, and automate routine client communication. Features may be added, changed, or removed over time, and some features may be limited to certain subscription tiers.
2.1 Connecting your Instagram Business account
If you connect an Instagram Business (or Facebook Page) account, you authorize us to access it through the official Meta Graph API for the sole purpose of operating the features you use, including:
- Publishing content on your behalf. When you create a post, carousel, or caption in the App and choose to publish or schedule it, we submit that content to Instagram using your connected account’s publishing permissions. Content is only ever published as a result of an explicit action you take — either a direct “Publish”/“Schedule” action, or an automation you have configured and approved in advance.
- Reading basic account information and, where the inbox feature is enabled, messages associated with your account, so you can view and reply to client conversations from within the App.
You represent that you have the right to connect the Instagram Business account you use with the App, and that doing so does not violate Meta’s own terms and policies, which continue to apply to your account independently of these Terms. You can disconnect your account at any time in App settings or through your Facebook Business Integrations settings; see our Privacy Policy for details.
2.2 Connecting a calendar
You may connect a calendar so the App can work out when you are free. If you do, you authorize it to read the busy periods from the calendars you select, and to add appointments you confirm to a separate calendar it creates for that purpose. The App reads only when you are busy — not the titles, notes, locations or attendees of your entries — and it does not alter entries it did not create.
Suggested times are a draft, not a commitment. The App proposes appointment times from your calendar and your working hours; nothing is offered to a client until you send it, and no appointment is created until you confirm it. You remain responsible for the times you offer and for honouring the appointments you accept.
Availability is only as accurate as the information the App has. An Apple Calendar can be read only while the App is open, so its view of your week is as of the last time you opened it; a calendar you have not selected, an entry marked as free, and an all-day entry are not treated as making you unavailable. The App shows you how recently it read your calendar and declines to suggest times when that information is too old to rely on, but you should check a suggested time against your own calendar before sending it if anything has changed since.
You represent that you have the right to connect the calendar account you use with the App. Your calendar provider’s own terms continue to apply independently of these Terms. You can disconnect a calendar at any time in App settings; see our Privacy Policy for what is deleted when you do.
3. Your content
You retain ownership of the photos, videos, captions, client records, and other content you upload to or create in the App (“Your Content”). By uploading Your Content, you grant us a limited license to host, process, and display it as needed to operate the App, and — only when you direct us to — to transmit it to Instagram for publishing. We do not use Your Content to train third-party AI models or for any purpose beyond operating the App and improving its features for you.
You are solely responsible for Your Content, including having any necessary rights, consents, or releases (for example, client consent for before/after photos) before uploading or publishing it.
4. Acceptable use
You agree not to:
- Use the App to publish content that is unlawful, infringing, defamatory, or that violates a third party’s rights or consent.
- Use the App to send unsolicited bulk messages or spam to clients or others.
- Attempt to access another user’s account or data without authorization.
- Reverse-engineer, scrape, or interfere with the App’s operation or security.
- Use the App in a way that violates Meta’s Platform Terms, Instagram’s Terms of Use, or applicable law.
We may suspend or terminate access for accounts that violate this section, including where required to comply with Meta’s platform policies.
5. Subscriptions and billing
Certain features require a paid subscription. Pricing and included features for each tier are described on our website and may change with reasonable notice. Unless stated otherwise, subscriptions renew automatically for successive billing periods until cancelled, and fees are non-refundable except where required by law. You can cancel at any time; cancellation takes effect at the end of the current billing period.
6. Automations and human review
Automated messages and publishing actions run only for flows you have explicitly configured and approved. You are responsible for reviewing automation settings and templates before enabling them, and for monitoring their output. We are not responsible for the content of messages or posts sent by an automation you configured and approved.
Appointment suggestions and booking detection are aids to your judgement, not automations. The App may propose times, and may recognise that a client appears to have accepted one and offer to add it to your calendar — but it does not send a message, create an appointment, or write to your calendar unless you act. You are responsible for checking that a proposed appointment matches what was actually agreed before accepting it.
7. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if continued access would create risk or legal exposure for us or others. Upon termination, your right to use the App ends, though certain provisions of these Terms (ownership, disclaimers, limitation of liability) survive.
8. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that any specific publishing, automation, or content outcome will be achieved, including outcomes dependent on Instagram’s own availability, policies, or algorithms.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the App. Our total liability for any claim arising out of these Terms or the App will not exceed the amount you paid us in the twelve months preceding the claim.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date above, and where required, we will provide additional notice. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which our company is established, without regard to conflict-of-law principles, unless applicable consumer protection law in your country of residence provides otherwise.
